The People's Committee of Ho Chi Minh City has just issued Decision No. 26/2025 on the management and use of apartment buildings, including notable content on tightening the management and use of apartment buildings, especially the short-term rental of tourist apartments. Accordingly, for the exploitation of apartments for tourist accommodation (short-term rental, by day, hour, airbnb...) in apartment buildings, the People's Committee of Ho Chi Minh City stipulates that only mixed-use construction projects (tourist apartments) are allowed to operate tourist accommodation rental business. Organizations and individuals doing business in tourist accommodation services must meet the conditions and regulations on conditional investment and business lines; and at the same time register for temporary residence for rent according to regulations.
For apartments, the regulation only allows them to be used for residential rental purposes, and absolutely not for other purposes (short-term tourist accommodation, airbnb...). The landlord must sign a contract with the tenant. This regulation clearly states that it is not mandatory to notarize the rental contract, but this will be the basis for determining the responsibilities of both parties. In case the tenant uses the apartment for other purposes, they will be held responsible. In addition, the new regulation requires the management board and the management board to base on the apartment rental contract to require the tenant to comply with the rules and regulations on management and use of the apartment building to ensure security and order.

The model of renting apartments for short-term tourist accommodation is flourishing in Ho Chi Minh City. Supporters of this form say that apartments bring convenience such as spaciousness, can accommodate many people, cook together, and live comfortably like at home. In particular, the price of renting an apartment is also cheaper than other traditional types of accommodation, saving costs for the company, especially when often traveling in groups and staying for a long time.
Grasping the needs of customers, the market for renting apartments for short-term accommodation in Ho Chi Minh City has grown strongly in recent years. The areas where this service flourishes are often in central locations, with convenient transportation and apartments in the mid-range segment and above, concentrated in areas such as District 1, District 4, Binh Thanh.
However, along with that, renting also causes many consequences affecting the security of the apartment building and the lives of residents in the area. People said that having too many tenants coming and going continuously causes disorder in the apartment building, especially for tenants who are companies and businesses renting short-term houses for business purposes. The frequency of walking in the building lobby and floor corridors, using amenities such as elevators, swimming pools, gyms, etc. by short-term tenants affects the quality of life of residents. Many short-term tenants do not have the awareness to protect common property. In addition, frequently meeting strangers in the building can lead to anxiety and insecurity for residents.
Short-term rental activities can increase housing prices and reduce the opportunity to own a home for those who really need housing. Similarly, there are concerns about security and ensuring utilities in residential areas, tax issues as well as managing rental transactions safely. Therefore, the issuance of this ban is supported by many residents of the buildings. However, experts say that the ban will affect the central apartment market, in the mid- to high-end segment. Apartment prices and rental prices will also be affected in the short term.
